just waiting for the phoo to hit fan
been to CAB and they have said to go bankrupt. just as i thought with debets of 30400. not bothered about a bit of hassele till forms are filled in and returned to CAB, just whant to ask a couple of qestions please. i have a account with the co-op but with a overdraft, i am going to close the overdraft and ask for just a basic account before i go bang. is that the way to do it. will i have to stop all direct debits i am paying like car insurance and will i have to pay all payment in full after going bang. is there anything to watch out for in filling forms in.
only in trouble in last six weeks.

Rather than just cancelling your overdraft, you need to open a new co-op cashminder account. You can stop all the DDs you do not want to continue with and transfer all the DDs you do want to continue with to the new account. It can be difficult getting car insurance without paying up front once BR and the cost is usually hiked up some. I'm sure there have been some successes on here though, have a search in the forums. Nothing to 'watch out for' in the forms, just be as honest and informative as possible.
thanks for you reply, i took out the account with the co-op just the other month nowing that things went going well, am i better to ask the co-op pryer to the date of going bust. also looked for info on car insurance after BR but cant find nothing ?. any idea if things like talktalk phone etc have to be scraped or can i just keep payng them as i do now as i need them as i am disabled. i also have a 2000 hp agreement for car the 2000 is the amount owing. i have been told that if i explane that i need the car and that the moneys from dla/mobilty pay for the car a nd insurance, do u think i may get away with keeping it as a hp car on mobility will cost 1000 depost for the car i need to get scooter in etc. thanks again.

I opened my account about a month before I went bankrupt to give me time to transfer my DDs etc and the OR was fine about it as it is a basic account with no overdraft facility or cheque book. You can keep your mobile and contnue with the contract, however this is usually expected to come out of your surplus unless used for business. If you can show you NEED it due to your disability they may allow you to include it in your expenses. Not too sure about the car, from what I know HP items are usually not included in your bankriptcy and are reclaimed by the HP company. With your disability and the money coming from your DLA to pay for it you may be able to convince the OR to let you keep it. However the HP company may still reclaim it, you will need to check your contract with them for bankruptcy clauses.
Get the co-op cashminder beforehand, run DD straight from that, make sure all income is set to go in it a week before BR day. Car insurance: we were with directline, and havent had any issues, just kept paying monthly DD from new account. I got new insurance for my bike with a different company no issues. BT still done by DD, as are mobiles and mobile broadband with vodafone.
If you have a Co-op account with an overdraft make sure it is NOT in the OD when you go BR and you owe the Co-op money or they will close the Cashminder account.
You just keep paying all your normal bills. Landline, mobile, insurances (although you will need to tell them you are bankrupt to make sure you are covered - you don't want to be paying out only to find if you need to make a claim you aren't covered) utilities etc.
thanks for the help all, sparkle83 did you tell direct line once you where br. i only hope the OR and toyota will let me keep car and virgin insurance play ball. as the car has 20 more payments left and that is only what the car is worth at present. oh well, next time i am comeing back as a well looked after dog, at least i will get fed and watered etc. even my dog is very well looked after and has no worries about liveing in this dam life. cheers all.
i am going to chaange my bank account with co-op to a basic account, and i should be made br with 3 weeks me thinks. when i go to court they tell u to stop using bank account, so how do i contine to recive my benifits and pay dd befor i see the OR. thanks.
Hi Snoopy83, When you open your new Co-op account, transfer all you benefit ayments & dd to the new account. Depending on what you are on DLA, CB, CTC took a week as mine were all due and payments were fine. Carer's Allowance took 10 days as it's paid weekly. Not sure about any other benefits as my HB & CTC is paid direct. Just remember to make sure all payments are received in new acct before setting up DD's. Most you can pay for by card so you could tell Companies when you change details that the next payment will be paid by card & the DD are to come out the following month i.e November. With regards to your car you can do two things: firstly look in your credit agreement for the T&C's and see if there is a BR clause. If there isn't rig the finance company and ask them outright what is their policy on BR. Are you payments up to date? If there is a clause but your payments are up to date then you may be able to keep it. That's what I did and it was no problem. The OR won't be interested as you use it for mobility but it's the FC that can put spanner in works.
thanks miss spooky, when i change account from primium to basic at co-op this week do i just keep paying dd as before, sorry to ask but still not sure?. will the OR closed the account now or will i have to waite a bit before they let me use it again. thats the bit i dont understand sorry. what do i do from the BR date to the OR interview. big thanks. oh do i just tell co-op nothing as to why i am changeing accs over. . this thing is doing my head in.
Snoopy it's not the OR that closes bank accounts it's the banks themselves, the OR can tell you to stop using certain bank accounts you may have but they are generally only interested in those you owe money to or maybe have a stash of cash in. The OR should have no interest in your basic account which you need to continue using for day to day living. My co-op account didn't get frozen and the OR said they had no interest in it, I just carried on using it as normal.

Just ring your car insurance and say you are going BR and do they have a problem with that. If they don't want your business they will say so. You should be able to find some one who will insure you paying DD's each month.

well some good news, some not so good. my car finace company said i can keep car and if i need to have payments cut they will sort things out, no prob with br at all. then phoned virgin insurance about car, no prob as long as payments are ok just keep paying. brill just down to OR after BR. cab cant see my forums untill 21 oct as they are inandated with dro. still at least i feel good to day now. even sorted one card company and told them if they keep ringing the the oft will hear from me within the next week for hassment, that was that . just need to sort the dam outgoings out right so i dont show much left over. keep thinking what is missing or should i not add dla low rate plus mobility high rate to my weekly long term incapasity. sorry dam awful speller. eh what a life. oh and moorcroft group sent me a 14 day wait, so i can contact them regarding continuing payments on a 19 year nat west account that was 2195 owing, paid 35 a month for a few years, guess wahat i owe as of yesterday, 4375. not bad, shows i am doing the right thing by going BR.

In fact....my OR didn't actually contact Co-op for over a month after BR!!! [I rang Co-op the week after my BR, spoke to nice lady, told her my BR details, and she informed me that, whilst she has simply logged the information, they do nothing unless and until the OR contacts them.They even have a special BR department who deal solely with this...] IN truth, after BR, you actually DO have the means to pay for insurances, etc.....rather than the situation beforehand??
got forms checked by cab wendsday, he said i had done a good job. so rang the court and i have made apponintment for tea and cucumber sandwichs with judge shortly. just so i can turn the volume back up on the house phone. let u know how it goes. tell u what bloody expnsive 510.00 and no crips for a sandwich..
