Bankruptcy (What can creditors report)
After my discharged Bankruptcy in June of 2002, And receiving my credit report from the three major CRAs i discovered that some of my creditors that were included in my bankruptcy reports a charge off or reposession months after the discharge. And there was one that was sent to collections after discharge. I am working on correcting these, however can anyone shed some light on how the CRAs take this info and accept it as truth when they already have conflicting data and proof of its incorrectness. They have the Public record of my discharge and still falsely report some accounts. what gives?

hmmm......on one hand I need to fight this with my chapter 7 discharge schedule f on the other hand if I do than i can not get the bankruptcy off my report in the future. ok, so. my question is...is removing the bankruptcy more helpfull than four derogs? or is the four degrogs just an added negative bonus with the bankruptcy. Eye YI EYeThe creditor reporting this is in violation of the BK laws,not to mention the FCRA. Take the issue up with the creditor and the BK court or BKTrustee Your lawyer who did the BK foryou ETC in order to force the creditor to report correctly to the CRAs. You want to resolve this through them not the CRAs.

Ok I know that enforcement of the FCRA is not likely so perhaps notifying the lawyer up there in Ma. is the way to go. Thanks I will shoot a letter out to his office tomorrow. BTW I likley already shot myself in the foot by includiong a copy of the dischagre with my disputes to the CRAs. Live and Learn I guess. Guest   Top

Oh you have a case if you want to go that route, I don't know of others (actually had not follow-up on them). I would suggest contacting your bankruptcy attoney first, and letting them know of the continual collection efforts on the creditor / collection agencies part. Bankruptcy Code will have listing on violations / fees that can be awarded for this. Another possible contact for this would be http://www.edcombs.com - especially going after collection agencies. Suprised they could move that fast, that would of taken a phone call to the CRA on their part to move on this. Usually the fastest I see updates is 3 to 5 days.
