How many days holiday if now 'on the books'?
Hi all, I'm wondering if anyone can answer my query!?
My partner was self-employed working for a construction/building firm, he was put 'on the books' about 18 months ago but is only getting 2 weeks paid holiday. From what I understand this should be 19 days plus the bank holidays so a minimum of 27 days per year. He has also not received any payslips! If he is now an employee of this company what should he be receiving by law? I've told him to speak to his boss but hes being very hesitant in case his boss says he can't afford it & lays him off. I suppose if he has to pay my partner 4 weeks holiday a year he'll have to pay all his workers 4 weeks... Is there another 'on the books' that I'm not aware of where a boss can pay 2 weeks?
The basics of holiday rights There is a minimum right to paid holiday, but your employer may offer more than this. Make sure he really is "through the books" by contacting the tax office to make sure his tax & NI are being paid. If not he is working "cash in hand" unknowingly which could cause him trouble in the future.
Thank you. I hope his boss is paying his tax & NI, sounds rather dodgy if he isn't. So assuming he is on the books is he owed 28 days holiday a year?
I assume Zara'a facts are correct so yes he should be entitled to 28 paid leave - this would include bank holidays though, not as well as.
28 days inc bank hols usually works out at around 3 weeks (well it does for my OH who's a heating engineer/plumber), so it's still well under. Can you ask the boss for a payslip, and if he doesn't give them, then contact HMRC
